How a society answers these fundamental questions plays an essential role in how it responds to crime, from developing crime prevention programs to designing incarceration systems and rehabilitating criminals. Criminal behavior may be purposeful for the individual insofar as it addresses certain felt needs. Criminal behavior refers to conduct of an offender that leads to and including the commission of an unlawful act.
Criminal behavior usually is measured by arrests and charges, self-reported offences (which is believed by some to be more accurate), actual crime rates, which are usually obtained by governmental organs. Public law is most often established by a governing body, and will therefore vary between countries and states. Defective, or abnormal, mental processes may have a variety of causes, i.e., a diseased mind, inappropriate learning or improper conditioning, the emulation of inappropriate role models, and adjustment to inner conflicts. Criminal Behavior When crime is truly the product of rational choice, the offender commits the act for reasons of personal gain or gratification. Following are examples of case laws on criminal behavior: Sexual acts with a 10 year old child clearly constitute criminal behavior. His or her behavior is under his or her complete control. For criminal behavior to result in a conviction, not only the act (actus reus) must be proven, but the criminal intent or mental state (mens rea) behind the act must be proven as well. Criminal behavior, or offending, is generally defined as any overt or covert law-breaking conduct in a given country or state, punishable upon conviction. Criminal behaviors that lead offenders to recidivate are often called “risk factors” or “criminogenic needs” (National Institution of Corrections & Services).
